The Nakawa Chief Magistrates Court has dismissed a case of inciting violence against National Unity Platform (NUP) Deputy Spokesperson Waiswa Mufumbiro, citing lack of jurisdiction.

The ruling was delivered on Thursday by Grade One Magistrate Frank Namanya, who agreed with the defence team’s submission that the charge sheet did not specify the exact location where the alleged offence was committed.
Mufumbiro had been accused of inciting supporters in Kampala to attack and kill security personnel. The charges included incitement to commit an offence under Section 21(1) of the Penal Code Act.
According to the prosecution, the alleged offence occurred on September 4, 2025, within Kampala, where Mufumbiro was said to have urged National Unity Platform supporters to engage in violent acts, including murder, against security personnel.
However, the defence argued that the court lacked jurisdiction to try the matter because the charge sheet failed to clearly state the precise place where the alleged offence took place. Magistrate Namanya upheld the objection and dismissed the case.
Despite the dismissal, Mufumbiro remains in custody over separate charges of unlawful drilling before Kanyanya Magistrates Court, where he is jointly charged with several others.
One of his lawyers, Serunkuma Frank, has threatened to sue the government for what he described as malicious prosecution of his client.
The state has not yet indicated whether it intends to refile the dismissed charges in a competent court.
