Kampala-The Supreme Court has adjourned to 12th February 2026 the ruling in a matter where Attorney General challenges Constitutional Court ruling on Prosecution of interdicted Principal Accountant in Office of the Prime Minister, Geoffrey Kazinda.
In August 2020, the Constitutional Court held that Kazinda had been subjected to continuous and unlawful prosecutions arising from the same allegations. The court then ordered for his immediate discharge in all pending cases and barred the State from prosecuting him on the same matters.
The judgement in this matter was expected to be delivered on Monday 12th January 2026, however it was not possible due to the fact that the trial Justices had some questions they had to put before the parties in this case before writing their decision.
The main issue that raised concern for the panel was that the matter which was appealed against was heard by five Justices of Constitutional Court, but the judgement which was attached to the appeal had only four Justices’ decision which raised a legal question.
The panel of justices in this matter who included; Chief Justice Alfonse Owiny Dollo, Christopher Madrama, Lilian Tibatemwa Erikubinza, Percy Night Tuhaise, Elizabeth Musoke and Catherine Bamugemereire gave the Attorney General’s side and Kazinda’s team time to respond to that legal question before the judgement is delivered.
Kazinda who was present in court, has been pushing for this Court decision for close to five years now while in Luzira Prison.
Kazinda has been in Luzira Prison since 2013 where he has served a number of sentences on charges related to illicit enrichment, corruption and embezzlement.
