Entebbe Senior Grade One Magistrate, Edgar Tusiime Tibayeita on Thursday adjourned the hearing of the fraud case against land broker Hajji Muhammad Kamoga.
This followed the request by Kamoga’s lawyers after the broker through to court , to halt criminal proceedings against him pending hearing and determination of his appeal in the Supreme Court.
Kamoga, whose application was a week ago dismissed by Supreme Court Judge Monica Mugenyi, told the Magistrates Court that he has filed a reference to have his application heard and determined by a panel of three judges.
Through his lawyers, Kamoga told the court that he filed a reference to challenge the single judge decision and have the criminal proceedings stayed until final determination of other pending civil cases.
“We filed reference number 1 of 2025 challenging the decision of the judge of the Supreme Court which gave this court a green light to handle these cases and it is pending. We believe that the accused person will be prejudiced if these cases proceed before the reference is heard and determined,” said Mr Alex Kamukama one of Kamoga’s lawyers, while objecting to Kamoga pleading to eight additional fraud charges as per the amendment of charge sheet on court record.
However, the state Prosecution objected to Kamoga’s pleas describing them as delaying tactics and an abuse of court process intended to alter a decision of the Court of Appeal and Supreme Court ruling requiring expeditious hearing of the criminal cases against Kamoga.
“Now counsel has filed a reference just two days ago attempting to set aside a decision of the single judge of the Supreme Court. These references and appeal are baseless, frivolous, and intended to stifle the process of court and to delay justice that is deserving,” said the state attorney, Mr. Ahebwa Paul.
After listening to the arguments of both counsel, the trial magistrate Tibayeita adjourned the case to 18.08.2025 to make a ruling since the file had just been allocated to him.
Kamoga had appeared before the Magistrates Court presided over by Grade One Magistrate, Edgar Tusiime Tibayeita, hardly a week after the then presiding Chief magistrate recused herself from proceeding with the matter after Kamoga had alleged that he was actively communicating with her through WhatsApp messages. Kamoga had also failed to block his prosecution before the Supreme Court.
Kamoga who is facing multiple charges of forgery, obtaining registration by false pretences,uttering false documents, unlawful eviction and malicious damage to property regarding fraudulent acquisition of a 200 acre land at Garuga-Bukaayain Entebbe, Wakiso District.
Kamoga is accused of forgery of signatures of businessman Peter Bibangamba on transfer forms for land at Bukaya, Entebbe, fraudulently acquiring registration, uttering false documents, unlawful eviction and malicious damage to property.
His legal troubles stem from allegations that he used forged transfer forms to unlawfully transfer land ownership from Peter Bibangamba into his names for over 200 acres of land.
